{"id":6455,"date":"2021-05-23T15:08:40","date_gmt":"2021-05-23T15:08:40","guid":{"rendered":"http:\/\/congresogro.gob.mx\/62\/inicio\/?p=6455"},"modified":"2021-05-24T15:09:50","modified_gmt":"2021-05-24T15:09:50","slug":"plantean-reforma-para-garantizar-el-pago-de-salarios-vencidos-a-trabajadores-despedidos-injustificadamente","status":"publish","type":"post","link":"https:\/\/congresogro.gob.mx\/62\/inicio\/2021\/05\/23\/plantean-reforma-para-garantizar-el-pago-de-salarios-vencidos-a-trabajadores-despedidos-injustificadamente\/","title":{"rendered":"PLANTEAN REFORMA PARA GARANTIZAR EL PAGO DE SALARIOS VENCIDOS A TRABAJADORES DESPEDIDOS INJUSTIFICADAMENTE"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Chilpancingo, Gro., a 23 de mayo<\/strong><strong> del 2021.-<\/strong> Para que se respeten y paguen los salarios vencidos a trabajadores despedidos injustificadamente, desde la fecha de inicio y hasta el cumplimiento del laudo laboral, el diputado Carlos Cruz L\u00f3pez propuso reformar la Ley Estatuto de los Trabajadores al Servicio del Estado, de los Municipios y de los Organismos p\u00fablicos Coordinados y Descentralizados del Estado de Guerrero.<\/p>\n<p style=\"text-align: justify;\">En su propuesta, el legislador se\u00f1ala que con la reforma al art\u00edculo 48 de la Ley Federal del Trabajo se estableci\u00f3 la obligaci\u00f3n del patr\u00f3n de pagar, en caso de un despido injustificado, salarios vencidos por un periodo m\u00e1ximo de 12 meses, y si al t\u00e9rmino de ese periodo no ha concluido el procedimiento o no se ha dado cumplimiento al laudo, se pagar\u00e1n al trabajador intereses sobre el importe de quince meses de salario, a raz\u00f3n del dos por ciento mensual, capitalizable al momento del pago.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, mencion\u00f3 que dicha reforma se hizo sin realizar un estudio serio que justificara la necesidad de un cambio en la materia, sin un razonamiento econ\u00f3mico, social o laboral que determinara efectivamente si el trabajador era el culpable de la existencia de una indebida pr\u00e1ctica, a efecto de prolongar la duraci\u00f3n de los procedimientos laborales.<\/p>\n<p style=\"text-align: justify;\">En todo caso, indic\u00f3, si el patr\u00f3n estima que pag\u00f3 en exceso salarios ca\u00eddos, dada la lentitud del juicio, deber\u00eda demandar al Estado la reparaci\u00f3n del da\u00f1o, el cual, conforme al art\u00edculo 1\u00ba de nuestra Constituci\u00f3n, est\u00e1 obligado a reparar las violaciones a los derechos humanos; m\u00e1s no al trabajador, quien es la parte m\u00e1s d\u00e9bil.<\/p>\n<p style=\"text-align: justify;\">Por ello, plantea que si en el juicio correspondiente no comprueba el patr\u00f3n la causa de la rescisi\u00f3n, el trabajador tendr\u00e1 derecho, cualquiera que hubiese sido la acci\u00f3n intentada, a que se le paguen los salarios vencidos desde la fecha del despido hasta que se complemente la sentencia.<\/p>\n<p style=\"text-align: justify;\">Esta propuesta de reforma a la Ley citada se turn\u00f3 a la Comisi\u00f3n de Desarrollo Econ\u00f3mico y Trabajo para su an\u00e1lisis y emisi\u00f3n del dictamen correspondiente.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chilpancingo, Gro., a 23 de mayo del 2021.- Para que se respeten y paguen los salarios vencidos a trabajadores despedidos injustificadamente, desde la fecha de inicio y hasta el cumplimiento del laudo laboral, el diputado Carlos Cruz L\u00f3pez propuso reformar la Ley Estatuto de los Trabajadores al Servicio del Estado, de los Municipios y de&#8230;<\/p>\n","protected":false},"author":1,"featured_media":6456,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[30,39],"tags":[],"class_list":["post-6455","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-boletin","category-carlos-cruz-lopez"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.5 -
